DAMAGE TO PROPERTY WHILE PERFORMING SERVICES

I. LIABILITY EVENT. Under the terms of this Release of Liability (hereinafter referred to as “Release”) and sufficiency of which is hereby acknowledged, you, the client, hereby release and forever discharge Summit Snow Removal LLC (hereinafter referred to as “Summit”) of any damage that may occur at, or to, your property, the address of which you have previously provided to Summit (hereinafter referred to as the “Property”), in the course of Summit removing snow from the Property or after the snow has been removed. This damage may be as a result of the release and falling of ice dams (the accumulation of frozen water in the gutter system and at the roof edge that prevents subsequent drainage of melting snow), the release and falling of icicles that may fall on, or into, the Property, or any other damage that may occur related to ice, water, or snow falling on, or into, the Property (These events independently or collectively known as the “Liability Event”).

THEREFORE under the terms of this Agreement and sufficiency of which is hereby acknowledged, do hereby release and forever discharge Summit including their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the Liability Event.

II. MITIGATION OF DAMAGES. Summit shall attempt to mitigate damage that may occur at, or to, the Property in the course of removing snow from the Property by attempting to take ice down from the Property’s roof in smaller portions, providing plywood to cover windows at the Property, or by any other means reasonably calculated to reduce the likelihood of damage.

III. PAYMENT. As part of this Release, the parties agree that Summit shall make no payment to you, the client, if a Liability Event were to occur at the Property. The parties also agree that you, the client, shall pay Summit for the time spent removing snow and ice from the Property, regardless of whether a Liability Event occurs..

IV. BINDING EFFECT. This Release shall be binding upon you, the client, and your respective heirs, executors, administrators, personal representatives, successors and assigns.
